(See image above for the wording in the <em>Nepali Times<\/em> article.)<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p dir=\"ltr\" lang=\"en\">.<a href=\"https:\/\/twitter.com\/nepalitimes\" target=\"_blank\" rel=\"noopener\">@nepalitimes<\/a>, contrary 2 ur contention, <a href=\"https:\/\/twitter.com\/hashtag\/Kafala?src=hash\" target=\"_blank\" rel=\"noopener\">#Kafala<\/a> system has NOT been abolished. Words changed, system intact. Here&#8217;s a quote from the article.<\/p>\n\n\n\n<blockquote><div>&#8216;Nicholas McGeehan, Qatar researcher for Human Rights Watch, said that it would be apt to describe the new laws as \u201cold wine in new bottle.\u201d \u201cQatar has just given the dreadful \u201ckafala\u201d system a new name in the hope that people will be too stupid to notice. Nepal and other countries that send young men and women to Qatar should be making their objections loud and clear,\u201d McGeehan told the Post in an email interview.&#8217;<\/div><\/blockquote>\n\n\n\n<p>Discovering the Nepali times article this morning, it occurred to me that the misreporting must be rampant! So I did a quick search. I Googled &#8220;qatar kafala system.&#8221;<\/p>\n\n\n\n<p><span style=\"font-size: 15pt;\">Sure enough, pretty much every article published on &#8212; or since &#8212; December 13 uses the word &#8220;abolished&#8221; or &#8220;abolishes&#8221; in their headline!<\/span><\/p>\n\n\n\n<p>One article that came out this month, however, goes into the details of the issues with the law. Published in Dohanews.co, on Dec. 13, it headlined <a href=\"https:\/\/dohanews.co\/rights-groups-skeptical-new-labor-reforms-take-effect-qatar\/\" target=\"_blank\" rel=\"noopener\">Rights groups skeptical as new labor reforms take effect in Qatar<\/a>.<\/p>\n\n\n\n<p>When unveiled, back in 2015, HRW (<a href=\"https:\/\/www.hrw.org\/news\/2015\/11\/08\/qatar-new-reforms-wont-protect-migrant-workers\" target=\"_blank\" rel=\"noopener\">Qatar: New Reforms Won\u2019t Protect Migrant Workers<\/a>), Migrant-Rights.org (<a href=\"https:\/\/www.migrant-rights.org\/2015\/11\/qatar-renaming-kafala-is-not-ending-kafala\/\" target=\"_blank\" rel=\"noopener\">Qatar: Renaming Kafala is not Ending Kafala<\/a>) and International Trade Union Confederation (ITUC) (<a href=\"http:\/\/www.ituc-csi.org\/qatar-s-labour-law-reforms-a-sham\" target=\"_blank\" rel=\"noopener\">Qatar\u2019s labour law \u201creforms\u201d a sham<\/a>) had blasted the law. (<a href=\"http:\/\/media.al-sharq.com\/portalfiles\/pdfissue\/%D9%82%D8%A7%D9%86%D9%88%D9%86%20%D8%A7%D9%84%D8%B9%D9%85%D9%84.pdf\" target=\"_blank\" rel=\"noopener\">Click here<\/a> for the original Arabic version of the law.)<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"http:\/\/dorjegurung.com\/blog\/wp-content\/uploads\/2016\/12\/ITUC-Qatar-labor-law-reform-sham.png\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" width=\"552\" height=\"288\" src=\"http:\/\/dorjegurung.com\/blog\/wp-content\/uploads\/2016\/12\/ITUC-Qatar-labor-law-reform-sham.png\" alt=\"\" class=\"wp-image-10877\" srcset=\"https:\/\/www.dorjegurung.com\/blog\/wp-content\/uploads\/2016\/12\/ITUC-Qatar-labor-law-reform-sham.png 552w, https:\/\/www.dorjegurung.com\/blog\/wp-content\/uploads\/2016\/12\/ITUC-Qatar-labor-law-reform-sham-300x157.png 300w\" sizes=\"(max-width: 552px) 100vw, 552px\" \/><\/a><\/figure>\n\n\n\n<p>HRW followed up their November report with <a href=\"https:\/\/www.hrw.org\/news\/2016\/01\/27\/qatar-failing-crucial-labor-reforms\" target=\"_blank\" rel=\"noopener\">another one<\/a> in January 2016.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"http:\/\/dorjegurung.com\/blog\/wp-content\/uploads\/2016\/12\/HRW-Qatar-failing-on-reforms.png\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" width=\"551\" height=\"291\" src=\"http:\/\/dorjegurung.com\/blog\/wp-content\/uploads\/2016\/12\/HRW-Qatar-failing-on-reforms.png\" alt=\"\" class=\"wp-image-10879\" srcset=\"https:\/\/www.dorjegurung.com\/blog\/wp-content\/uploads\/2016\/12\/HRW-Qatar-failing-on-reforms.png 551w, https:\/\/www.dorjegurung.com\/blog\/wp-content\/uploads\/2016\/12\/HRW-Qatar-failing-on-reforms-300x158.png 300w\" sizes=\"(max-width: 551px) 100vw, 551px\" \/><\/a><\/figure>\n\n\n\n<p>Here&#8217;s the most important paragraph from the report.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8216;In October, Qatar\u2019s Emir, Sheikh Tamim bin Hamad Al-Thani, issued Law No. 21 of 2015, regulating the entry and exit of repatriates and their residency. The new sponsorship law refers to \u201crecruiters\u201d instead of \u201csponsors\u201d but leaves the fundamentally exploitative characteristics of the <em>kafala <\/em>system in place. Workers must still obtain a\u201cNo Objection Certificate\u201d from their employer if they want to transfer legally to another employer. Workers also must still obtain exit permits from their employers to leave Qatar. The new law provides a grievance committee for cases in which sponsors refuse to grant exit visas, but the arbitrary restriction on a worker\u2019s right to leave the country remains in place.&#8217;<\/p><\/blockquote>\n\n\n\n<p><span style=\"font-size: 15pt;\">So, the point is, Qatar has NOT abolished the <em>Kafala<\/em> system.<\/span><\/p>\n\n\n\n<p>The reason for the interest of the Nepalese in the labor laws in Qatar is the presence of half a million of our fellow citizens in the country, a significant number of whom suffer all the time, many of them from the <em>Kafala<\/em> system.<\/p>\n\n\n\n<p><span style=\"font-size: 15pt;\">It was the <em>Kafala<\/em> system that <a href=\"http:\/\/dorjegurung.com\/blog\/2014\/09\/casualty-of-qatar-17-years-of-yearning-for-home\/\" target=\"_blank\" rel=\"noopener\">trapped Roshan Kumar<\/a> for more than a decade in a deportation center! It was the <em>Kafala<\/em> system that <a href=\"http:\/\/dorjegurung.com\/blog\/2014\/11\/we-neither-got-the-visa-nor-our-salaries\/\" target=\"_blank\" rel=\"noopener\">trapped<\/a> these Nepalese worker in an untenable situation. It was the <em>Kafala<\/em> system that <a href=\"http:\/\/dorjegurung.com\/blog\/2015\/07\/bound-to-kafala\/\" target=\"_blank\" rel=\"noopener noreferrer\">prevented<\/a> the Nepalese in Qatar from returning home to tend to their families in the aftermath of the April 25 and May 12 earthquakes last year.<\/span><\/p>\n\n\n\n<p>And those are only the ones I have blogged about! Shabina Khatri did that write-up as well as a couple more about me and my ordeal, which helped spread the word of my predicament around the world.<\/p>\n\n\n\n<p>Nicholas, Vani, James and Aakash were involved in rescuing Roshan Kumar from his nightmare! After publishing <a href=\"http:\/\/dorjegurung.com\/blog\/2014\/09\/casualty-of-qatar-17-years-of-yearning-for-home\/\" target=\"_blank\" rel=\"noopener\">his story<\/a>, I got in touch with all of them, including Shabina, <a href=\"http:\/\/dorjegurung.com\/blog\/2014\/10\/the-beginning-of-the-end-to-a-17-year-yearning\/\" target=\"_blank\" rel=\"noopener\">via Twitter<\/a>, and they managed to get Kumar out of Qatar within a month!<\/p>\n\n\n\n<p>And of course, if you read some of the articles, you would have also noticed that a couple of them were the ones quoted.<\/p>\n\n\n\n<p>Follow them and trust them to produce and provide reliable news about what&#8217;s going on with labor-related issues in the region.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Jan. 5, 2017 Update<\/h4>\n\n\n\n<p>Dohanews <a href=\"https:\/\/dohanews.co\/new-qatar-law-amended-to-remove-moi-exit-permit-procedure\/\" target=\"_blank\" rel=\"noopener\">reports<\/a> that two recent changes have been introduced to the new law. The first change reverts the law back to how it used to be: expats need permission from employer to leave the country. The second, an improvement from before, expats who want to quit their jobs and leave has recourse: they can petition &#8220;the grievance committee&#8221; for help, instead of simply &#8220;absconding&#8221; and being an illegal as was the case in the past for lack of options.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>News published in numerous publications around the world over the past week, describing how Qatar has abolished the extremely restrictive Kafala system, is NOT true.
